MAGISTRATE'S COURT
CIVIL BUSINESS. MOVING PICTURE PEOPLE AT LAW. In the Magistrate's Court yesterday, Mr. W. G. Riddell, S.M., delivered his reserved .judgment in the civil case, in which Domb and Allen, picture theatre proprietors, Lyall Bay, proceeded against Adams and Adams, trading as tho Empress Film Company. to recover the sum of £39 Is., alleged to be due for debt and damages. _ The allegation was that the plaintiffs Jiad incurred expense in having put in order a dynamo purchased by them from defendants, and that loss of profit had resulted from tho breakclown of the dynamo. At tho hearing Mr. A. 11. Bindmarsh appeared for the plaintiffs, while Mr. D. G. Jackson appeared for the defendants. The Magistrate was of opinion that the plaintiffs could not succeed on the claim for general damages, or for tho cost of providing a place, to instal tho engine,' as the latter was an oxpenso which tho plaintiffs would have heon put to whether tho engine ivas accepted by them _or not. Plaintiffs were, entitled to some damages, which His Worship fixed at £12. Judgment was accordingly given for .the plaintiffs for this amount, with costs and expenses totalling £3 l(is. UNDEFENDED CLAIMS. Judgment by default was given for the plaintiffs in the following undefended claims: Mrs. F. E. Lieher v. F. W. Dusky, £3 os., costs 175.; Wellington Investment, Trustee, and Agencv Co., Ltd., v. Elizabeth Wilson, £■1!) 10s. Bd., costs £2 us.; H. K. Kobertshaw v. Ernest Snhutw, £1 Ms. lid., costs 75.: H._ Ilewett and Co., Ltd. (.in liquidation), v. Edward Mai, £4 135., costs 10s.; P. Haymau and Co., v. N.Z. Sports and Pastimes, Ltd., £1.2 7s. 6d., costs £1 10s. Od.; Game v. D. Sheahan, £23 13s. 9d.. costs £2 145.; J. Rod and Co. .v. Harold Douglas Barton, £2 18s. 10d.. costs (is.; Gilbert Henry Lvster v. Victor L Fairbrother, £72 ss. Gd., costs £1 10s.; Mrs. Hannah Davies v." Frank Pater, son, £3 135., costs 6s. JUDGMENT SUMMONSES. . George Smith was ordered to pay D Wilson the sum of £7 19s. 3d. on or before March 21, in default to undergo seven days' imprisonment. Michael John Hogan was ordered to pay William Campbell, Ltd., tho sum of £3 18s. 7d. on or before March 21, in default to undergo three days' imprisonment. POLICE CASES. Police cases were taken before Mr. D. G. A. Cooper, S.M. Joseph'Tulle.y, who had been found helplessly drunk on -iLambtoii Quay on February 2S, wits ordered_ to pay 17s. Gd. expenses connected with his curative treatment in gaol. Default was fixed at 48 hours' imprisonment. John Harrison, foi drunkenness,, was fined 10s., the alternative beiog 48 hours' imprisonment. James Patrick Shivnan, who hod been found in an outbuilding at the lelepliono Exchange yesterdav morning, pleaded not guilty to a charge of being a rogue and a vagabond.' Ro wns defended by Mr. H. F. O'Loary. After hearing: the police evidcnco as to tno excuse given by the accused, tho Magistrate dismissed the information without- calling on the defence. Charles /Harry Graham, a respectablydressed young man, pleaded guilty to a chsjrge of drunkenness, and to a further charge of stealing toilet requisites valued at ICs. Gd. from tho shop of E. M. Green, in Vivian Street. It, appeared that Graham had gone to the shop, ordered a/mixture, and while this was being prepared, filled his pockets with articles from tlic counter. Tho theft was discovered before Graham left the shop, and he was handed over to the police. On the ehanrn of drunkenness tho accused was convicted snd discharged, but passing of sentencfl for_ the theft was deferred until the polico could make inquiry as to previous character. Bail was allowed in the sum of £10.
