IN THE CAGE OF RESIGNATIONS. (By Telegraph— Spccial Correspondent.) Wanganui, October ?. Mr. W. Kerr, S.M., delivered judgment yesterday morning in a case of some interest to teachers. It had to do with what is a usual practice—resigning before tho holidays, but letting tlio resignation take cffect at tho end of tho vacation, : with the object of drawin"' pay for tho period covered b?r tlio holiday. The caso was one in which a lady teacher, about to bo married, resigned on December 17, stating that her resignation would talto cflect oil January 31 following. Tho Education Board paid her only to the end of December, and sho sued for salary for January. . ' In giving judgment tho Magistrate entered a nonsuit against tho teacher, on tho ground that'no proof of resignation had been produced in Court. Section 61 of tho Education Act provides that ail teachers must give one month s notice of resignation in writing to tlio board and tho School Committee, and the same provision is found in Section 78 of tho Wanganui Education Board s regulations, tholigh tho languago of tho Act was the moro imperious. There was no proof at the hearing of the case that proper notice had been given, and tlio Legislature must havo had good reasons for making tho provision regarding notice as it had done.
