Evidence was given that attempts were made to induco a drunken man to leavo the premises, and a pretence was made of sending for the police. Mr. Frazer, S.M., said it was admitted the man remained fourteen minutes in It was not denied that the licensee made efforts all that time to persuade him to leave. The licensee had a staff of men at hand, and was guilty of indiscretion in not usin<* force to remove the man. Ho imposed a nominal penalty, and added t'hat ho would not endorse the conviction on the license. Counsel for defendant said the oase was of importance to licensed victuallers; and he asked the magistrate to stato a case for appeal. Counsel s view was that the law did not require a licensee to use physical force. Mr. Frazer agreed to state a case.
