This is the appeal «of defendants ill connection witli the first prosecution under the Commercial Trusts Act, 1010. Mr. Justice Williams is presiding at the appeal, and sitting with hint are Mr. Justice Denniston, Mr. Justice Cooper, nnd Mr. Justice Chapman. The appellants are tho Merchants Association of New Zealand, Inco)'l>ornted. a trade protection society, Wellington; the Colonial Sugar Defining Company, Ltd., incorporated in New South Wales, sugar refiners and sugar merchants, Auckland; Levin and Co., Ltd., AY. M- Bannatyno and Co., Ltd., and Joseph Nathan and Co., Ltd., all merchants of Wellington. Tho respondent is bis Majesty the King. Mr. C. P. Skerrett. K.C., with Sir. 1. Young, is appearing for tho Merchants Association, and for W. SI. Banuatyne and Co., Ltd., and Joseph Nathan, and Co., Ltd. Sir. J. It. Hosking, K.C., of Duncdiu. with Sir. It. I'. Richmond, of Auckland, represents the Colonial Sugar i Helming Company, Ltd., while Sir. M. Myers is in the case as counsel lor Levin mid Co., Ltd. The Attorney-General (the Hon. A. L. Ilerdmau) is appearing for tho Crown, and he has with him Sir John Vindlay, K.C., and Sir. 11. 11. Ostler, of tho Crown Law Office. . , During the course of Sir. Hosking s argument yesterday, tho question arose as to the "attitude of the Crown oil the second case, in which .Levin and Co. had been treated as principals and in which judgment had been given in favour ot defendants. Sir. Hosking said ho did not know whether tho Crown proposed to appeal from that decision in Iho event of the present appeal beinff allowed. Mr. Justice Williams (to tho AttorneyGeneral): What do you say to that Mr. Attorney? 1111 Atloniev-General: I think wo had better reserve consideration of our attitude Oil that point, your Honour.
