Whittnkcr, borfo trainer, of Ellcrslic, was held heforo tho Official Assignee to-day! Bankrupt sets,down his liabilities to unsecured creditors at JU47, Jand'his assets at .£125,. leaving a deficit of ,£322. ■ In his sworn statement'bankrupt' states tliat ■he • came, to New Zealand and commenced business as, a' horsetrainer at' Christchu'rch.' Ho had about .£IOO in cash when he landed. As he could not get enough good bones to train in. Christchurcb, he'went to Duuedin and Invcrcargill with about £>0. He stayed at Invercargill for, about 18 months, and, for tho first twelve' months ho did well, although during the' last six months he got into debt, and,.when ho left for Wellington, he owed about .£IOO. After working for several people, he started a laundry business, but-it did not pay. Bankrupt's wife borrowed .£25 to put into the business. Bankrupt came to Auckland in April, 1912, and he arranged to take a lease'of Glenora Park, at Papakura, and borrowed about ,£SO to commence trainiii", but, seeing stables at Ellorslio, he arranged to take thorn instead. On August 5 a bailiff was put in for rent, and, a, few days later, another, these proceedings being under a bill of sale. There was also an order out for his arrest under a judgment-summons.,' His license was also refused, and bankrupt was compelled to file. ' . After bankrupt/a affairs had been discussed at length, the Assignee said that he did not think that the examination had disclosed sufficient evidence. of bankrupt having placed himself -under the penal laws by obtaining credit by misrepresentation, but. at the same time, ho thought that a- charge of obtaining credit when having no' reasonable expectation' of payinir .would hold.- . On-Mr. Wittneh's behalf,' Mri Singer moved that, bankrupt's statements and documents be placed in tho hands of tho Crown Solicitor, with, a view to prosecution under the Bankruptcy Act. - This was seconded and carried.
