LABOUR PROSECUTIONS.

DEPARTMENT REPLIES TO JUDGE sn L In reference to the prosecution by tho Labour Department of the Auckland. Waterside Workors' Union for striking, we aro asked by the Department to nrnke the following statement As some reflection is being cast upon the action of tho Department in prosecuting the union instead of the men concerned, the Hon. the Minister has authorised the following statement to bo published:— (1) It was ou tho advice of tho Crown Law Office that the union was prosecuted. (2) When the defence was raised, in the S.M. Court that in this ease the union was not responsible for the action of Its officers, the magistrate advised the inspector to withdraw the case, and file it afresh in the Court of Arbitration in order to settle the important question raised. This course was followed, and the Crown Solicitor was engaged by the Department to conduct the 'esse. S. 'Action is now being taken against tho men concerned.

In regard to the dwwrion of the Arbitration Court at the hearing of the dispute between certain employers and the Waterside Workers' Union: In this case the Court ruled that tho cancellation of tho registration of the union shoukl not have been withheld by tho Registrar, on tho ground that the application for cancellation was received by him before the proceedings for tho hearing of the dispute were commenced. The reply of the Department is that it appears to have been stated in the Court that the date cf commencement of proceedings was January 31—one day after the application for cancellation was received. Tho official advice received from Auckkud by the Registrar as to tho date of commencement of proceedings was January 9 (not 31)—21 days before the application for cancellation icas received. It is required by tha Act that when tho proceedings in an industrial dispute liavebeen commenced before tho application for cancellation is made, the cancellation must be held over by the Registrar until the dispute is disposed of.
