BATTERED AND BRUISED.

ALLEGED ASSAULT AT A SCORIA

~ ~ , , Auckland, June 9. At the Police Court to-day, William Sherry was charged that at Ellerslio, on May 11, ho assaulted Martin Monaghan, causing him actual bodily harm. On the night in question, Monaghan, a draper .residing at Ellerslie, was found lying in an unconscious condition, and had to be taken to tho Hospital. The accused voluntarily gave himself up to tho police next morning, and was charged with assaulting Monaghan. Martin Monaglum, who lias now almost recovered from his injuries, gave evidence that on tho day of the assault somo time in tho evening tho accused's wife was in a scoria pit near Ellerslie. Witness was with the woman. Sherry camo up and said: "I'll kill vuu. You with my wife. I'll kill you.' 5 Accused punched him all over tho head, bashed his head on tho ground, caught hold of him.,by,, tho throat, and nearly ehokbd him. Mrs. Sherry tried to pull accuscd away, and accused hit her. lie remembered Sherry coming back and kicking him in the side, when his rib was broken.

Dr. William Gillies Borrie gave evidence as to Monagliau's injuries. His face was bruised and swollen practically all over. Both eyes were bruised, swollen, and discoloured, and an eyelid cut. Both lips were swollen and bruised, the lower ono bearing an abrasion inside. Tho nose was fractured. There were five serious wounds to tho scalp, ono of them extending to tho skull, and tho outer bone of the skull was split off. Tho seventh rib and tho left tlngh wero fractured. Numerous bruises wore on tho arms and body. Tho injuries wero very severe. Constable Sherman, in charge of Ellerslie Police Station, said he had known about Sherry's domestic troubles. Sherry had told him that ho had como homo from work and found his wifo absent. An infant of about six or seven months was left in tho care of a child of six. After putting tho children to bed Sherry had gone out to look for his wife. _ Witness told him ho had seen her go in tho direction of tho scoria pit, and walked with Sherry part of tho distance. Then he returned, and he had got about six hundred yards away when he heard screams like a woman's, and went back. Sherrv, who met him, told witness ho had found his wife, and said "That black was with her." Accused was liko a Accused reserved his defence, and plead* ed not guilty, lie was committed to the Supremo Court for triau bail boiflfii & lowed in a surety of .£SO.
