BALCLUTHA. November 8, 1377. (Before E. H. Carevv, Esq., R.M ) Police v. Townsend. — Charge of permitting gambling. Mr Taylor for defendant. Information dismissed. A MQ an v. Robbie.- Claim of L 7 2s. Mr Henderson for plaintiff ; Mr Rsid for defendant, pleaded not indebted. John Allan stated that he supplied the deceased Mr Robbie with the goods charged for, and Mr Robbie had received a sum of L 2 12s from another customer on plaintiff's account. Mi*s Robbie had admitted to him that she had received monies that her late husband's life was insured for. Ha did not know whether she had taken out letters of administration or not. I Cross-examined by Mr Reid — He did i not know how the policy was made out, whether for Mrs Robbie and the children or not. A. 0. Campbell, who was in the Court, was called, and said he was one of two buudsmen for Mrs Robbie, to see that she administered the estate properly. He did nob know whether she had actually taken out letters of administration or not. She had informed him that she had received her late husband's life insurance monies. Mrs Robbie was also called, but did not appear, though a subpoena had been taken out for her. It appeared, however) that it had not been served. Mr Reid submitted that there was no evidence that the plaintiff had administered the estate, or that there was any estate to administer, and plaintiff must be nonsuited. Judgment was given for defendant without costs. Mitchell v. Forno.— Claim of L 7 17s 6d. Of this amount L 4 2s had been paid, and plaintiff admitted a contra account of hi 18s. Judgment by default for the balance, LI 17s 6d, and costs of Court, 265. .
