WELLINGTON, .July 15. The applieatiou of .Mrs. Latsy Louise Francis Haskeli for leave ro appeui from her conviclion on a charge of murder at Auckland was disiuissed by thc Court of Appeal in a ■ judgmenl delivered this morning. The judgment, wlucli was delivered by .Mr. Justice Jvennedy, rejected al! the submissions of eounsel for .Mrs, Haskeli. As to ihe iirsl submission — that thc prisoner had been tried by a jury of 11 — the Court held that the submission > had no foundution iq law or 011 tlu. faets. As to the second submission•tliat the verdict was against the weigh; of evidence — the Court said that in its view there was ample evidence to sujj port the jurv's verdict, and in particu lar it could not be said that, the jury could not reasoiiablv liave reached the conclusion it did as to the identitication of the prisoner wit-h" the person who committed the murder. As to the third submission — that thc Jtudge in his directions to the jury hac! failed properlv to put the case to tlu jury — the Court said that the summing up, far from being unsatisfactory, did in its opinion fairly and adequately place the issue before the jury.
