O11 the ground that the hardship on the owner was greater, Mr. Justice Fair, in the Supremc Court, grantcd a petition by Bertram Hector Clayton for possession of a flat from his ten.it, Arthur Leonard Martin. The evidence showed that Clayton and his wife, aaughter and ns had been living in one room and a tent for nine months, for which they were paying £2 weekly, and Martin was paying 18s weekly for the flat which he had been jccupying for 11 years. His Honour said the petitioner and his wife and family had been living in one room for nine nonths, #and therefore there was no reason why defendant and his wife could not live in a single room for six months until they could occupy a transit flat or another hopsS.
