MAGISTRATE’S COURT Probation For Indecent Assault On Boy

A man said to have hypnotised a 15-y ear-old boy before indecently assaulting him was released on probation for three years by Mr H. J. Evans, a-M in the Magistrate’s Court yesterday. An interim suppression of tns name was granted pending a decision to appeal against his conviction. TCie offender, a 37-year-old clerk, was said by his counsel, Mr D. H. Stringer, to be appearing on a such a charge for the first time. ’ Because of this, and the fact that publicity could affect the boy himself, Mr Stringer sought suppression of name. The Magistrate said that extensive psychiatric reports had not altered his view that although the offender had been convicted, after trial, of • serious crime providing for up to 10 years’ imprisonment, imprisonment was not an appropriate penalty in this case. On the “quite important matter of suppression of name,’’ the Magistrate said that he considered it his virtual duty to order an interim suppression if an appeal was to be made. A final order on suppression of name would depend on whether the appeal did proceed. In placing the offender on probation, the Magistrate ordered him to pay £lO towards the cost of his prosecution. CHARGE DISMISSED A charge against Stanley Hall, a watersider, of failing to yield the right of way at the give-way sign at the corner of Gloucester street and Stanmore road was dismissed. Hall, who pleaded not guilty, was represented by Mr M. J. Glue. The charge arose out of a collision between a car driven by Hall and one driven by John William Ullrich on March 21. REMANDED FOR REPORT Philip John Cameron, aged 50, a storeman (Mr I. C. J. Polson), was convicted and remanded till July 4 for a probation officer's report on a charge of attempting unlawful sexual intercourse with a girl under 12 years at Amberley on June 12. He pleaded guilty. FINED £lO Kenneth John Ackroyd, aged 18, an Insurance trainee, pleaded guilty to a charge of using insulting words within the hearing of other people in Hereford place on June 21. He was convicted and fined £lO. For Ackroyd. Mr S. G. Erber said that the offence occurred on the spur of the moment and was prompted by an honest belief rather than maliciousness. DRUNK Peter Moon McLean, aged 55, a factory workman, was convicted and fined £2 on a charge of being drunk at the Christchurch railway station about 8 pm. on June 21. He pleaded guilty by letter. Detective Sergeant D. Porteous said McLean had been convicted on a similar charge six months previously. BENCH WARRANT

Crosby Frank Cook, aged 45. a workman, failed to appear to answer charges that at Christchurch on February 17 he drove while disqualified and that he failed to give his name and address to a traffic officer. The Magistrate ordered that a Bench warrant be issued forthwith for Cook’s arrest In respect of the driving while disqualified charge.
