MAGISTERIAL. ' WEDNESDAY. . (Before Mr H. P. Lawry, S.M.) OX ENCLOSED PREMISES. Margaret McDermott and Archibald Lynn were charged "with being found on enclosed premises in Moorhouso a-venue "without lawful excuse, but in circumstances that did not show any intention to commit a crime. Each accused was fined 30s, in default 48 hours imprisonment. UNDERSIZED FISH. Huia Miles and Albert Edward Miles were charged with taking an undersized flounder from the Waima&ariri. Mr C. M. Rcnaut, i 0 j a PP eare d for the Marine Department, asked for a heavy penalty. An earlier case had been brought as a warning, he said. The Magistrate said that that earlier case involved the same men and the same haul of the net, so that it could not constitute a warning. Both accused pleaded' guilty and were ordered to pay costs. REPIAIRS TO SEWER. An occupier of premises, 11. R. Baker, who liaa failed to make repairs to a sewer on his property at 296 Hereford street after notice had been given, was ordered to pay costs. Mr J. 1 . I. Cowlishaw, who appeared for the Drainage Board, said the case had been Drought to Court a fortnight before and had been adjourned to give defendant a chance to do the work. The work had been completed on the previous day. For a similar offence at 354 Armagh street, Robert Cnghngton was fined £l. TRAFFIC PROSECUTIONS. Andrew Clarence Ede, for cutting a corner on a motor-cycle at New Brighton, was fined 10s aqd costs. John Hay, who failed to produce his driver s license when riding a motor-cycle at\New Brighton, was fined £1 and costs. lium- Lee was charged with driving an unlicensed car and with driving a car not having the proper number plates. On the first charge he was fined £3 and costs and on the second £2 and costs. For riding a motor-cycle at New Brighton 2 n j, 1« a cut-out, Lester Marriott wis fined 10s and costs. Harry Nunes, for riding a bicycle on the footpath at New Brighton, was fined 10s and costs. Robert Sutherland was fined 10s and costs lor driving a motor-car not being the holder of a driver's license. For cutting a> corner, Norman Swift was fined 15s and costs. Keith Legge was fined 5s and costs for riding a bicycle on the footpath at New Brighton. BT-LAW CASE. Leonard David 'Richards (Mr Roy Twyneham) wag charged with erecting a stack of timber, within 15ft of a building without putting up a protecting separating wall. Mr R. J. Loughnan appeared for the City Council. Decision was reserved. MAINTENANCE CASE. Mabel Thurza Hern sought • a separation °F, r » ® maintenance order, and a. guardianship order against her husband, Albert James Hern, of Selwyn street. Mr W. J. Tracy appeared for the wife, and Mr Cottrell for the husband. All three claims were dismissed by the Magistrate, who said the whole case had arisen out of domestic bickerings that could easly be overcome Ijy the display of a little consideration by each party. The hearing of the case began on Monday and was then adjourned until yesterday morning, four and a half hours being occupied by it yesterday.
KAIAPOI. (Before Mr Ei D. Mosley, S.M.) Sydney F._ Pearce, charged with attempting to obtain liquor during the currency of a prohibition order, was fined £3. Hon Turia, on a charge of disobedience of a, maintenance order, being in arrears £& 13* 6d, was convicted and sentenced to three months' imprisonment and ordered to pay costs £2 2s. , CIVIL CASES. Judgment for plaintiff by default was given in the following cases:—Blackwelh, Ltd., v. H. Gilbert, claim £3 lis 7d; same v. M. Quinlivan, claim £o 18s Dd; same v. L, McQueen, claim £8 lis Od: same v. E. Bickerby,' claim £2 Is 6d; W. Clarke and Son v. A. Erickson, claim £9 8s 6d. JUDGMENT SUMMONS. In Blaclrxolls, Ltd., v. B. Wright, claim .£3 6e 6d, the debtor, who <lid not appear, was ordered to pay the amount due forthwith, in default three days' imprisonment.
