, JUDGE ALLOWS APPEAL. A (yjnst ASSOCIATION TKi*oa*JJ.) AUCKLAND, March 8, ' Mr Justice Herdman to-day allowed the nppeaVof Ah Chuck, a, market gardener* against a Magistrate's order j adjudging hini |bo father of ? child born to Mrs Elizabeth Evelyn Hedge*, while she was mairicd to and living faormally with her husband. The appeal was by way of a re-hear mg. j Mrs Hedges'# evidence, which was that Ah Chuck was the child s father, | Was provisionally admitted. I Medical evidence was e« v en to the effect that the chxldwnsa hajf-caste, with Mongol characteristics. It was >s9o established that six months after the child's birth Hedges obtained a divorce from his wife on the giound of her misconduct with Ah Chuck. _ ■ Mr Justice Herdman, in his judgment, cites the law that a husband or « wife cannot illegitimate a child unless it is" clearly proved that it was impossible for' bbth of them to be its narents. He therefore excluded Mrs Hedges's evidence and held that the remaining evidence was insufficient to with iio 10s fcosts.
