NO POWER OF REFUND. ;PRESS ASSOCIATION TELEGKA.iI. I HASTINGS. October 28. A legal absurdity was disclosed at a meeting of the Borough Council. A ratepayer and his solicitor, unknown to each other, paid the rate demand, and the ratepayer now requests a refund. . < The Mayor, quoting legal opinion, said that the Council had no power to refund and that crediting the sum to nest year's account would amount /» a refund, and would be illegal. The money could not be taken from the borough suspense account under present legislation, and if a refund were made by the Council they would be personally responsible. The Council was not the owner of the money, and nauld not use it, as it belonged'to someone else, but that person could not get it back. It was resolved to urge that the Act be amended.
