ARBITRATION COURT.
CLAIM FOR COMPENSATION, .'"' A "claim for compensation, for an'accident was heard..in the Arbitration Court yesterday afternoon, before his Honour Mr Justice Frazer *and Messrs.' "W. -Scott (representing the employers) and H; Hunter, (representing the workers). - ", Walter Edward Campbell; of Chriatchurch, gardener. (Mr K. G. Archer), claimed compensation from Herbert Henry Cook, .of Chriitchurch, land agent (Mr J. D. Hutchinson). The statement of claim set* out that, on or about May 3rd, 1924, wh!!e claimant was in the employ of the defendant, as a gardener, he suffered injury by an accident to his left thumb, which ho. cut with an axe and sub&equenti r .had to have amputated. He had boon unable, s!nce then; to do any- work. ..Claimant's average werfcly v. ages for the twelve months prior to the accident were £i '4b.' He had. received £23 2s for compensation lip to July 19th, 1924. The defence was/.a.'.. general denial of the allegations.. '■"..- -.>..- Mr Archer said claimant , had at first w rxed chiefly on timber, cutting. He was cutting trees into x firewood, ; when the axe slipped, rebounded, and cut Lis thumb. The only question which might arise was whether the claimant was covered by the. Workers' Compensation Act. " Mr Hutchinson said defendant "admitted that the amputatio.i of the thumb was necessary.
After lengthy - evidence had been given by the claimants-Mr Hutchinson moved for a non-suit. ' '' . ■•■"'■■
' After legal argument, had been heard/ his Honour said the insUra ce company had stood on its legal position . and was not covered b ylhe schedule. Judgment waa given for defendant. Costs were not applied for. ' .
