Lieut.-Colonel Whittaker retired in 1906. Mr Muir, continuing his opening address for the prosecution, said that among the documents iv his possession was a letter signed "James Rossness." Rossncss was formerly Lipton'e manager at Malta. He addressed the letter to Minto on October 18th, 1005, wherein ho said: —"Whittaker writes to-day for his 6ix-monthly cheque. I suppose tho contract requires renewal. * Evidence would bo given to show that when Whittaker went to Sheffield, he made a fresh contract abnormally favourable to Lipton's. Mr Muir added that the financial position of tho military defendants was such as not to place them beyond temptations by wealthy tradesmen, subordinate civilians, and the eervants of a wealthy corporation, who had a choice between obedience to orders and loss of position. Tho persons primarily responsible were Minto and Cansneld, the former being the controlling mind.
