INFORMATION DISMISSED
CROSSING OF BRIDGE MAGISTRATE UPHOLDS MOTORIST Charged with not having exercised reasonable consideration for other users of the road, Henry H. Mann (Mr Otley) pleaded not guilty in the Whakatane Magistrate's Court last Tuesday.
Inspector Dogge,t t described how on July 12, when travelling behind defendant at Thornton lie had noticed his car mount the Thornton bridge over which two* children were endeavouring to pass on horse-back. The defendant had stopped his car oil the approach,. and the who had been half-way over, refused to pass the car and retraced their steps.
Defendant's story was that he liad not seen the children until they advanced over the steep approach on the northern side. He had then pulled up and the engine stalled. The children finally went back and he bad followed on to the other side.
The Inspector had accosted himbut he. the considered he had taken the. safest course under the circumstances.
"I think it. would be drawing the matter too fine to enter a conviction in this case,'' said the. Magistrate. "The defendant seems to have done what most drivers would have done. When he saw danger he stopped his car. The information is dismissed."
