UNUSUAL MAINTENANCE CASK

The case of a wife conning back to live with her husband after having already procured a maintenance order for £2 per Aveek against him and persisting in collecting this sum was an unusual feature of the court p roceed in gs yes te rd ay.

John Robert Gillanders of Waimana (Mr B. S. Barry) appealed for a variation of the order made in favcair of hisi Avil'e, Adelaide Mary Gillanders (Mr Suckling) in 1936.

The plaintiff claimed that approximately for 5y 2 years since the order AA'as made the tAA r o parties had lived together on more or less friendly terms but that the defendant had insisted on the payment of £2 a week ly in spite of the fact that the husband Avas already defraying the household costs.

The defence Avas Mrs Gillanders had only returned home on account of her husband's! pleading with her to do so. She had agreed proA'ided only that he maintained the: alloAAance of £2 per Aveek. She had kept herself clothed on this sum and also maintained a cottage at Ohope.

The Magistrate said the order must lapse under the present circumstances, but plaintiff Aveuld have to understand that in the CA r ent of his wife leaving him again he would have to be prepared to make adequate provision for her.
