A "FORTUNATE ESCAPE." _$ainai Moksi, charged with assaulting and robbing a young jarmer named Wilson at Whakataue, was found not guilty by the jury, and was discharged. In dismissing the prisoner His • Honor remarked: "Let mc congratulate you, prisoner, on your most fortunate escape." CHARGE OF OBSCENE LANGUAGE. Thomas Wilson, who in the Lower Court had chosen the option of trial by a jury, now pleaded not guilty to the charge against him, which was one of using obscene language in Grey-street •on January Ist to Mrs Evelyn Smith. The evidence of Mrs Evelyn Smith "was to the. effect that the accused, in a state of intoxication, called at her front door, entered the passage uninvited, act-1 ed with shocking indecency toward her, and refused to go out till the arrival of her husband, for whom she screamed. Tbe accused used very obscene language,' both to her and afterwards to her hus-, band in the street in front of the house. The complainant's husband gave corroborative evidence-Cross-examined by Mr Lundon, witness denied that Mirs Smith herself frequently used the language attributed to ■ the aec_ed. f TODAY'S PROCEEDINGS. The case was resumed to-day, when witnesses for the defence denied "that the jaeeosed used bad language, and stated I that through a thin dividing wall the people next door heard Mrs Smith re- , hearsing with others the evidence they | would give in the case. The jury found the accused not guilty, i tuid he was discharged.
