CIVIL CASKS. Kissel v. Scott. Claim Us 6d. Mr Nalder for defendant. This was a claim ior the balance of an account. It appeared that a pack saddle had been ordered !>y Mr Scott for some one else, ami liv liad told Mr Kiet-el either to put it down to him or the other gentleman. Mr Kissel had put it down to Mr Scott, but the person who was the real owner of the saddle had subsequently p.iid for it with the exception of a balance of 14s 6d the sum dainiod for. On behalf of defendant Mr IValder said that when the owner of the saddle went to Mr Kissel to pay the debt, be distinctly asked, if there was any more owing , , and had been told there was not. As however, Mr Kissel's books which were produced in Court, showed on comparison with receipts that a ba'ance of 14s 6d was owing, the Bench gave judgment for the plaintifl for the amount claimed.

Defendant denied the debt in toto, saying that he had made an arrangment with plaintiff, that it shouid be paid by Mr T. Welsh who had borrowed JC-iO'O from plaintiff.
