AKAROA RESIDENT MAGISTRATE'S COURT.
+ Tuesday. April 12, 1881.
Before Justin Aylmeb, Esq., R.M.
CIVIL CASE. Jolmson v. Grange.—Claim, £2 2s. This claim was made under the following circumstances. It appeared that on the evening Of the 15th March plaintiff put up at defendant's hotel. When he had made up his mind to stay the night, he asked defendant's son to put his horse in a paddock. This was done, but in the morning the horse was non esf, and was ultimately discovered in the pound, having been run in by Constable Scott. Plaintiff was summoned by the police for having a horse at large. lie now sought to recover his line and costs, together with his expenses in coming over to Akaroa from Little River. Defendant pleaded tho custom in regard to paddoeking—" every caro taken, but no responsibility." Tie also Stated that he had informed plaintiff on a former occasion that lie had.no paddock accommodation, nnd had to trespass on the kindness of a friend if he tooic his horse in, If the horse had been in the stable he would ha\e held himself responsible, but lie thought it would he very hard if: he was held responsible for a tstrange horse breaking out of a paddock. Hia Worship reserved his decision till Tuesday. April 19th. The Court then adjourned.
