Lewis.—Charge of obstructing complainant while in discharge o£ his duty, when driving defendant's horses to the pound, I Mr Bartholomew appeared for plaintiff, and Mr Hutton tor defendant. Evidence was given tor plaintiff by himself and Frank Young ; and for the defence by Sophia Lewis, Edith Tucker, and Robert Lewis. His Worship said the evidence was very contradictory. Though he had no doubt the horses were trespassing on the streets, the evidence was not strong enough to satisfy him that the animals had been rescued by defendant as alleged in the information. The case would be dismissed. W. Noble v. Jas. Harvey; claim 13s 6d for goods supplied.—Judgment for plaintiff for 12s 6d and costs. <© WARDEN'S COURT, ALEXANDRA. Monday, September 14th, 1903. E Appleton, extension of time for survey of special claim.—Granted for 3 months. Opposed Applications Edwin Appleton applied for a waterrace, 12 miles in length, leading from Hope's Creek. The application was objected to by Messrs R Campbell and Sons, lessees of Galloway Run. Mr L Ryan appeared for the applicant, and Mr C C Hutton for the objectors. Evidence was given by Alexander Gunn, manager of Galloway Station, stating that this race would divide a portion of his run, and that it would be necessary for the working of the run that sheep bridges be erected. He said 25 bridges would be necessary, six to be 12ft wide, and 19 not less than 4ft wide. The applicant, in his evidence, said that the width of bridges asked for was unnecessary, and was much greater than that over other races in the district. The erection of such bridges would be an expensive matter, owing to the cost of timber and transit of same. Open crossings could be mad« to allow of sheep passing. His Worship said he recognised that conditions of the kind asked for would be a heavy handicap on the applicant, who had shown a good deal of enterprise ; still the interests of the runholder could not be ignored. From the' evidence adduced, he thought the width of the small bridges could be reduced to 3ft; but it was evidently necessary that the larger ones should be 12ft wide, for mustering purposes. However, he thought it would te better, if the parties interested would go over the ground together, and endeavor to come to some amicable arrangement. The application would be granted, subject to conditions re bridges, which would be made next courtday. Andrew ffilson, water race, Springvale Creek, near Watson's.—Objected to by Alexandra Poultry Company, the proprietors of the freehold below.—Mr Ryan appeared for' applicant, and Mr Hutton for the objectors.—After hearing, evidence, the Warden granted the application subject to half-a-head being allowed to flow down the creek at all times.
