DAMAGES TO COUNCIL REDUCED

DEFALCATIONS BY CASHIER IN NEW PLYMOUTH

(P.A.) NEW PLYMOUTH, Feb. 20. The damages awarded to the New Plymouth City Council against the Audit- Department were reduced from £8164 11s 8d to £5645 14s in a reserved judgment given to-day by Mr justice Stanton who heard the origninal petition of right in which the Council sued the Department for reimbursement of defalcations by the Council’s former chief cashier, Bruce Guilford, undetected by earlier audits. Before the judgment was entered for the £8164 the Crown challenged the correctness of the assessment on which the award was based, and it is on those proceedings that the ,latest decision is based. Mr Justice Stanton found that Guilford’s defalcations since March 31, 1945, did not amount to so large a sum as at first thought, and he reduced the damages accordingly.
