THE ACOU&ED DISMISSED.
At the R.M. Court this mornlner, before Mr Olllvler, Phillip Maguire was brought up on remand charged with having ac Wakanul on March 7<h, unlawfully wilfully, and maliciously burned down four Btackaof wheat the property of Jameß Coohrane, and of about the value of £150
Sergeant Felton said that on Saturday laat he oaw the man to obtain whose evidence the case had been adjourned. He haa been miaiuformed aa to the nature of the evldenoe this man could give, and he found that it would have only a alight bearing on the case. He did not propose to o*U any more evldenoe, au it would only be a waßte of time. He had three other witnesses, but he would not call them, ' as he was satisfied he could not establish apriynafacie case.
The Magistrate, to Maguire : Yoa wilH be dlßcbarged.
Mr Clayton : I appear for Mr Coohrane. I believe that he haa a complaint to make against Maguiro.
Mr Pnrnell knew no precedent for an application such as Mr Clayton's. If he had any complaint to make against Magalre let an information be laid and the caso brought on In the ordinary way.
The Maglstra'e aaid he could not de'aiu Magulre any longer. He waa now a frea man avid if Mr Oochrane wlahed to bring anything farther againnt him an information would have to be laid, The information could be laid at onoo and the case heard that day if MaguLe agreed to that course.
Mr Clayton Bald that hla oliont was present and. was prepared to raako a complaint on oath.
The Magistrate asked what waa the nature of the complaint,
Mr Clayton said that the complaint would be brought under the Justices of the Peace Aot 1882. tie proposed to bring evidence that Magaire had threatened to burn out Mr Coohrane.
Tha Magistrate ; Maguire.must be diacharged before I can go into that. I oan't detain him any longer ; ho is now a free subject- (To the police : That man must not be kept any longer.)
One of the oonstablea stated that Magulre had been liberated and was then outside the Court,
The Magistrate : Now I'll hear you Mr Clayton.
Mr Clayton took no farther steps In the matter then and it accordingly dropped.
