Petitioners allege that a piece of land, about 20 acres in extent, situated near the church at Moutoa, on the Manawatu Eiver, has been wrongfully conveyed to the Bishop of Wellington, and they pray for inquiry. Petitioner alleges that a block of land called Aotea has been surveyed by a surveyor named " Eakapata " (Eochfort ?), who is pressing the Natives for payment of his fees. He (petitioner) prays for relief. I have the honour to report that the Committee finds that the sum of £250 was paid as settlement in full for the land in question, they therefore have no recommendation to make. 14th July, 1893. No. 340, 1892.—Petition of Wiremu Taipua. Petitioner states that the Government wrongfully lay claim to the Motutere Block (Coromandel)., and now prays for relief. I have the honour to report that the Committee is of opinion that this petition should be referred to the Government, with the recommendation that effect be given to the Act specially passed in 1873 (" The Harata Patene Eehearing Act, 1873,") to deal with the case. 14th July, 1893. Petitionees allege that the Government has taken possession of a portion of the Tukituki Block, which they claim to be theirs through non-payment by the original purchaser. They pray for restitution or compensation. I have the honour to report that the Committee are of opinion that this petition should be referred to the Government, with the recommendation that the Resident Magistrate of the district should be appointed to inquire into the case, with a view of setting the matter at rest. 14th July, 1893. That the petitioners have been misinformed as to the intention of the Lunacy Department, for it is not desired to take the land without the consent of the Natives. Petitionees pray that legislation may be enacted to enable them to obtain a rehearing in the matter of Ohinemuri No. 20 Block, they having been deprived of the same through alleged wrongful judgments of the Native Land Court Judges. Petitionee prays that alienation of any portion of the Horowhenua Block may be stopped until satisfactory arrangements are made in regard to the alleged trust in connection therewith. I have the honour to report that the Committee is of opinion that the Government, before purchasing any portion of the Horowhenua Block, should cause inquiries to be made as to the alleged trust in connection with the same, and, if satisfied that a trust was implied, legislation should be introduced this session to protect the interests of the tribe. 23rd August, 1893. No. 118.—Petition of Te Hiea Pateoeo and Others. Petitionees pray for legislation to enable them to obtain a rehearing in the matter of succession to Apihai te Kawau. I have the honour to report that the Committee has carefully read the papers referring to the Orakei Block, and find as follows :— (1.) That the petitioners allege that they are the true successors of Apihai te Kawau. (2.) It appears that Apihai te Kawau died in 1869, and left a will appointing Paora Tuhaere his successor. Paora also claimed the land as being entitled to it. (3.) A Crown grant was issued in 1873 in favour of Apihai te Kawau and twelve others, of whom Paora Tuhaere was one. The land was antevested as from 10th February, 1869. (4.) In 1882 a private Act was passed, in which it was declared that Paora Tuhaere was the trustee of the land. (5.) On the 2nd March, 1883, Paora Tuhaere was declared in the Native Land Court to be the successor of Apihai te Kawau. At this Court the son of Apihai (Te Hira te Kawau) was present, and consented to such succession. The petitioners are the children of a daughter of Apihai (6.) Paora Tuhaere died on the 12th March, 1892. (7.) The petitioners did not in Paora's lifetime object to the succession order made in Paora's favour by any petition or by any proceedings in the Court. They, however, shortly before his death, and when he was in ill-health, did communicate with the Native Department. The Committee have not, however, had that letter before them. The succession order was at that time nine years old. (8.) In 1892 " The Orakei Succession Further Investigation Act, 1892," was passed, allowing one Bere Arama to apply for a rehearing as to certain succession orders, but not the order found fault with by the petitioners. (9.) An application was made to the Chief Judge for a rehearing on 23rd September last by Here Arama, and the same was filed awaiting inquiry, but no further action has been taken on the application.

(10.) The Committee, under the above circumstances, cannot recommend that a succession order more than ten years old should now be reopened, especially as Paora Tuhaere is dead, and perhaps much valuable evidence may not be now available. 23rd August, 1893. Petitioner alleges that, owing to errors made in the survey of the Aotea Manuaitu Block, his tribe has lost a large portion of their land, and he prays that the matter may be inquired into and properly adjusted. I have the honour to report that the Committee finds there seems to have been some doubt as to the correct boundary-line of the block in question ; they therefore recommend that the Government should instruct Mr. Bush, Eesident Magistrate, who is conversant with the case, to make full inquiries, in order that the matter may be fairly adjusted. No. 528.—Petition of Hoani Meihana. Petitioner prays that the whole of the purchase-money received or to be received by the Government for the 7,625 acres, which was taken in excess of the quantity the Natives intended should be included in the sale of the Pahiatua Block, may be handed over to the Native owners. This petition is a repetition of petitions dealt with in 1891 and 1892. In 1891 the Committee reported as follows : " As the Government have received an area of land largely in excess of the 125,000 acres mentioned in the deed of conveyance in connection with the purchase of the blocks of land known as the Wairarapa end of the Seventy-mile Bush as agreed upon by petitioners, this Committee is of opinion that the above petition should be referred to the Government, with the recommendation that the petitioners should be paid at the rate of 10s. per acre for the 7,625 acres said by them to be the excess." In 1892 the report was as follows :" . . . that the Committee is of opinion the recommendation of last session should be carried into effect, and therefore recommend that this petition be referred to the Government with that end in view." The Committee now wish to report that the matter has again been gone into, and that they are of opinion some compensation should be made to the petitioners. No. 165. —Petition of Haka Pewbne. Petitioneb alleges that certain interests in the Huritini Block were conveyed to her by her relative, Moko Hikitanga, whose claims in the block were investigated by the Native Land Court at the expense of the petitioner, and after the investigation the Judge found that the deed of gift was not sanctioned by law. She asserts that if the Judge had at once told her that the deed was illegal, she would not have been put to the expense of this investigation. The Committee are of opinion that the Government might fairly consider whether the fees of the Court regarding Moko's claim should not be returned to her. 27th September, 1893. I have the honour to report as follows : — That the whole question dealt with in this petition was reported on by a Eoyal Commission in 1890 (vide Vol. 11., Appendices, Session 11., 1891, G.-4). It is clear that the Natives have been wronged, and the only question is whether the local bodies interested or the Government should compensate them. The Committee is of opinion that it should be done by the Government, as the land was sold to the settlers, and provision made in the Public Works Act which enabled the local body to open a channel from the lake to the sea, and thus the proprietary rights of the Natives were interfered with.

No. 408.—Petition of Taekata te Tokoihi and 2 Others. Petitionees allege that the rents on certain lands in Eotorua whereon two hotels are built have been wrongly withheld from them. They pray that the same may be paid to them, or other relief granted. I have the honour to report that the Committee are of opinion that this petition should be referred to the Government, with the recommendation that an inquiry be held into the matter at Eotorua. 29th September, 1893. No. 487a.—Petition of Enoka te Taitu. Petitioner complains that the Native owners of the reserves of " tenths " in Wellington are unable to obtain payment of moneys due on the same. I have the honour to report as follows : The complaint of the petitioner really is that certain revenues from the " tenths " reserves, managed by the Public Trustee, have not been paid to the persons entitled. The Committee have been informed that the Trustee has hitherto been unable to distribute the rents, as there has been no decision as to these persons. The Committee recommend that this question should be referred by the Government to some Native Land Court Judge to determine, so that the revenues may be distributed. 29th September, 1893. Peaying that the present holders of the titles to the Kauwaeranga and Turipukunui Blocks may be prevented from selling the same, as they are in reality only trustees for their tribe. No. 582.—Petition of Eichaed Essex. Petitionee alleges that, through a misinterpretation of the law, the lease which he holds of the Oturoa Block No. 1 is rendered insecure, and that he is in danger of heavy losses in connection therewith. He prays that inquiry be made with a view of having his lease validated. I have the honour to report that this is a case similar to that of the Mangoahane Block, which was dealt with last session. The report in that case was to the effect that the interests of the European therein claimed were to be protected until some legislative action was taken in regard to the same. Owing to the late period of the session it is impossible to pronounce in any particular way upon the equities involved, but the primd facie evidence adduced discloses such a strong case in behalf of 'the petitioner, the Committee is of opinion that the rehearing allowed by law should be delayed, if possible, until next Parliament has an opportunity of dealing thoroughly with the whole matter. 3rd October, 1893. No. 398.—Petition of Alfeed Joshua Thobp. Petitioner alleges that he purchased the interests of two of the owners in the Otuturu Block, but, on the death of these persons, successors to them were wrongly appointed, who have sold their shares to the Government, and consequently he has been prevented from getting possession or completing his purchase. He now prays the payments on the said shares be made to him instead of to the Natives. I have the honour to report that the Committee recommends that the petition be referred to the Government for inquiry, and if it is found that the allegations contained therein are correct, that he should have favourable consideration and redress. 3rd October, 1893.
