A LENGTHY CASE

SUPREME COURT ACTION CLAIM FOR LOSS OF ARM The Chief Justice, Sir Michael Myers, is engaged at the Supreme Court, Hamilton, this week, hearing a claim by Harold Swindells, aged 22 years, labourer (Mr W. J. King), against New Zealand Soluble Slags, Limited, Hukitly (Messrs A. M. Gould and E. J. V. Dyson, Auckland), ir. which plaintiff claims £2BB 19s special damages and £3OOO general damages, for the loss of an arm by Swindells while employed by defendant company in June, 1940. The allegation is that the firm’s servants were negligent in not thoroughly instructing Swindells in his duties and not adequately protecting the machinery, which negligence allegedly resulted hi Swindells suffering the loss of his left arm. The case is being heard by a * special jury of twelve, of which Mr Bertram H. Andrews is foreman. Hearing commenced on Monday morning avid evidence was heard throughout the day. On Monday afternoon Michael Thomas Ryan, manager of an artificial limb manufacturing firm, Wellington, and Ernest Albert Humberstone, an employee of defendant company, were examin and at the adjournament at 6.15 t.i.* last named was still giving evidence. TODAY’S PROCEEDINGS On the court resuming this morning Humberstone was under crossexamination by Mr Gould. The case is considered likely to occupy the court throughout today avid most of tomorrow.
