UNUSUAL CASE
WORKER’S COMPENSATION MONEY WRONGLY RETAINED Alleging that a sum of money paid a labourer in compensation had been fraudulently retained, the general manager of the State Fire and Accident Insurance Department proceeded against Bertie Francis James Wall, labourer, of Pirongia, by way of a judgment summons in the Magistrate’s Court, Hamilton, today. Under cross-examination by Mr J. F. Strang, who represented the department, defendant admitted that he had received compensation in respect of an accident on July 24, 1939, while he was also drawing wages as an employee of the Waipa County Council. It was alleged that Wall received £33 8s Id, which was £lO 10s 5d more than he should have received. Plaintiff had been led to believe that defendant had been wholly incapacitated from work from July 25 to October 9. However, the defendant had worked for four days from August 29 into September and ultimately returned to work fully recovered on September 18. The magistrate, Mr S. L. Paterson, entered judgment for £lO 10s sd, with £5 3s 8d costs.
