RETIREMENT OF JUDGE

CRITICISM BY PREMIER REGRETTABLE PRECEDENT (United Press Assn.—Elec. Tel. Copyright) SYDNEY, September 1 The Prime Minister, Mr R. G. Menzies, commenting on Mr Justice Evatt’s retirement from the High Court Bench to become an official Labour candidate in the Federal elections, said: These are no doubt matters of personal opinion, but I regard the precedent as most regrettable.

“The Judiciary should be kept completely detached from party politics,” Mr Menzies added. “Mr Justice Evatt will be an opponent of the Government and of suggestions for a National Government. His election for Barton will be a defeat for the Government and its war policy.”

Mr Justice Evatt has replied to the Prime Minister. “ I feel that the Prime Minister, acting with scant generosity, has failed to observe the dictates of Australian sportsmanhe said. “My decision, which caused me anxious consideration, was influenced by the almost universal appeal that every Australian, who is able, should assist to the utmost in obtaining victory in war and security in peace.”
