LEGACY OF DALMATIAN JUDGMENT FOR PLAINTIFF A civil action in which a claim was made against the Public Trustee for the delivery of chattels and £331, being gifts mortis causa, was heard before the Chief Justice, Sir Michael Mve'rs, in the Supreme Court to-day. Claimant, Stephen Marinovich, restaurant proprietor of Hamilton, was represented by Mr A. L. Tompkins, and Mr F. A. de la Mare appeared for the Public Trustee. The chattels and money claimed by Marinovich were stated to have been given to him by the late Peter Babich, restaurant proprietor of Ward Street, Hamilton. Babich was intestate when lie died last October and the gifts were taken over by the Public Trustee. "There could be no complaint against the action of the Public Trustee in defending this action, for he was simply doing his duty,” said His Honour. "I have no hesitation in accepting the testimony of the plaintiff and of Gera. As to the money, I feel that, on the authorities cited, plaintiff is entitled to judgment in his favour. The other gift constitutes a valid donatio mortis causa."
