S.M.. before whom he appeared in the Magistrate’s Gourt. Hamfiton. yasterday afternoon. Accused was admitted to bail at £IOO Bernard Quill, a salesman employed by J. R. Fow, Ltd.. Hamilton, in evidence. said that on February 1 accused paid an account with witness's firm for £3 is with a cheque of the Bank of Australasia. Morrinsville. payable to J. R. Fow\ Ltd., for £9 10s. drawn on P. Ward. The balance on the account was given to the accused in cash as change. Witness added that accused had previously transacted business with Fow's. Cheque Returned The cheque which accused handed to witness on February 1 had been banked on three occasions, beinsr returned each time. • diaries Rupert Manuel, a farmer near Morrinsville. said the accused had been engaged on his farm as a sharemilker. the share to be a third of the factory cheque and one-half of the returns from the sale of pigs. Accused had to pay the previous sharenrlker £SO for pigs, and witness arranged with the Morrinsville Dairy Company for this amount to be advanced. the repayment to he made by deductions from accused's cream cheque. .Accused left witness after six weeks. There was £l9 14s 9d for pigs owing ito accused at this time, this amount i being paid to accused’s banking account in two amounts, £l3 Is 3d on January 2fi. and £fi 13s fid on February 13. At the present time witness j still owed £8 to accused. Advance to Accused

Joseph Lewis Faulkner, secretary of the Morrinsville Co-operative Dairy Company. Ltd., outlined in evidence the .arrangement made by his company to advance £so to the accused. The December supply of cream bv the accused was valued at £2O Jls 2d. Accused purchased goods to tlip value **f £3 from the company, and £5 was credded against the advance of £SO. There remained for accused out of the cream Cheque £JO 9s. Tn January accused's cream cheque amounted to £'.fi 9s 4d. Goods to the value of £l2 19s lid were purchased, while £3O was deducted from the balance owing on the advance. No remaining cheque was paid to accused. When accused ceased supplying to the company £ll 10s 7d. the balance of the £SO advanced, was still owing, and the amount had never been paid. Gibson Gilmour Porter, accountant of the Bank of Australasia, Morrinsville. said accused opened an account at his bank on December 22, 1937. Gn January 27. 1938. there was £7 to accused’s credit at the bank. Accused approached the bank at that time and asked to overdraw his account to the extent of £fi, stating that Mr Manuel owed him fl 4. The overdraft was allowed to the extent of £3 7s 8d so that accused could pay a promissory note on his Nine cheques were presented for payment at the bark after accused had left Manuel’s employ, the total value being £147 3s Bd. All bad been dishonoured.
