Defendant’s Case Addressing the jury, defendant claimed that plaintiff was actually trespassing on his, defendant’s property in occupying the two front rooms. These had never been let to plaintiff and defendant was quite entitled to make such repairs to these rooms as he desired. It had been stated by the plaintiff that there was a scarcity of houses in 'Huntly. It would not be likely for him to ask as low a rental as 15s a week for the house as a whole under such circumstances. Thomas Allen, a miner, of llunlly, called by defendant, said, that he had been in possession of the two front rooms when plaintiff took possession of the rest of the house. The family that had previously been in the house had paid 15s a week for the rooms in which they lived while witness had paid 7s 6d for his two rooms. Witness had left his rooms on December 24 and had then returned his key to defendant. It was the key of the front door of the house. He had never had any trouble with plaintiff or her family. Cross-examined, witness said that when plaintiff had entered the house he was contemplating building a house for himself. He had told Powell of this but defendant had told him he could stay in as long as he liked. Florence Lydon, married woman, of Huntly, said that she had occupied the two front, rooms after the last witness left. Witness stated that plaintiff was ‘ quite impossible” to live with. Plaintiff had cut-off witness’s light and witness had left after that. (Proceeding.)
