Asleep in a ditch with his feet dangling in the water, l r Joseph Patrick Fahy M 0). a motor mechanic, of Hamilton" was found by the police on the Whatawhala-Hamlllon Road on Wednesday evening after a motor collision, and appeared In the Magistrate’s Court, Hamilton, yesterday afternoon, before Mr S. L. Paterson, S.M., charged with being intoxicated while in charge of a motor van. Accused, who was represented by Mr W. J. King, pleaded guilty, and was fined £lO, and his driver’s license was endorsed until May 31, 1930. lie was allowed three months to pay the fine and expenses totalling £1 14s. Senior-Sergeant G. 11. Lambert, who prosecuted, said that accused was arrested at 2.30 a.m. yesterday. He had attended a ball at Frankton on Wednesday night, and had Imbibed too | freely in liquor. He had decided to take some of his friends home in the van he was driving, and while proceeding along the Hamilton-Whata-whata Road lie collided with a milk float which was on the incorrect sido : of the road. When found in the ditch accused was not easily aroused by the police officer, who was called to the scone of the accident. When examined by a doctor at the police station accused was found to bo in a stale of Intoxication. He was taken to the Waikato Hospital for exnmiualion with a view to ascertaining whether or not. lie had been injured in the accident, but wis discharged yesterday morning, as it I was found that he was suffering from the effects of the liquor only. The Youth's employer gave evidence as to accused's good character.
