CONTRACT BY F RAUD.
SHARES TO BE RETURNED. TRUST COMPANY INVESTMENT. RESERVED DECISION GIVEN. (By Telegraph.—Press Association.) CHRISTCHURCH, Monday. Holding that the contract was procured by fraud, Mr Justice Kennedy, in a reserved judgment issued to-day, ordered the Australasian Investment Corporation, Lid., to re-transfer to Gereoge Herbert Elliott £540 worth of debentures in the Investment Executive Trust of New Zealand, Ltd., and pay him £IBO for dividends received from tho Public Trustee in respect of debentures and £6O paid by Elliott. The judgment provided that Elliott should return to the company its shares allotted lo him. Costs were also granted to Elliott, a retired art master of Palmerston North, who brought Hie action against Hie Australasian Investment Corporation in Christchurch in April last, seeking a return of debentures transferred by him to the corporation together with cash paid pursuant to' the contract and dividends paid on debentures in the meanwhile on Hie grounds that the contract had been pro ,uied by fraud.
