RELATIVE ON JURY.

PARTY IN COLLISION CASE. JUDGE ORDERS NEW PANEL. (Bv Telegraph.—Press Association.) PALMERSTON Tuesday. An unusual position arose during the hearing of an action in the Supremo Court in which Mrs Elizabeth Crowther V 72). of Wellington. is claiming damages totalling £2755 as the result of a collision with a motorcar. defendants being Leicester G. Harris, service car proprietor, Roy Mervyn Blackford, car driver and Mrs Harris, wife of the first defendant, as owner of the car. Evidence was heard yesterday and tliero was some delay in resuming this morning. The Chief Justice Sir Michael Myers, announced that Mr O. Mazengarb, counsel for plainti(T. had ascertained that a son-in-law of w. James, a nephew of plaintiff, who was one of the chief witnesses, was a member of the Jury. It wds also known that James was in conversation yesterday with that juror. "It would never do in tho interests o f Justice to allow this trial to pro«d with the Jury as at present constituted." said the Judge. "Counsel are of the opinion, and l agree with them, that *he best course is t-> discharge tho iry and let the case he tried again with an entirely new Jury."
