Witness made for the centre of the road to avoid him but defendant again changed his course, striking witness as he endeavoured to return to the left—hand side of the road. At no stage had witness been on his incorrect side and he had not reached the crown o! the road in his swerve to the right. He had been earning £2 155 per week prior to the accident but since he had been living on charity. His sight had been considerably impaired. he could not concentrate and he was subject to severe dizziness. headaches and insomnia The injuries were still extremely painful. constant throbbing occurring behind the eye There had been no improvement in his condition over the past 15 months and he saw no prospect of returning to work.
Under cross-examination plaintiff said a dangerous operation might effect an improvement in his condition but the results were considered questionable by his medical advisers. Eye-Wltnou' Story.
