SEQUEL TO COLLISION

SUPREME COURT HEARING. NEGLIGENT DRIVING ALLEGED. Arising from a collision which occurred between a motor-lorry and a cyclist in Seddon Road on February 21. 1935, a claim tor damages totalling £1737 05 6d was brought in the Supreme Court at Hamilton to-day. Plaintifl' was Thomas Jones. painter. of Hamilton. and defendant was George John Baker, carrier. of Hamilton. Mr Justice Fair presided. Mr N. S. Johnson appeared for plaintifl and defend—ant was represented by .\lr J. F. Strong. In his statement of claim plaintifl set out that on or about February 21 he was riding his bicycle in a northerly direction along Seddon Road when a motor—lorry driven by defendant collided with him, Plaintiff was injured and it was alleged that defend—ant was negligent in that he drove at an excessive speed, failed to keep a \‘isilant look—out, neglected to keep to the left. of the centre-line and ot‘ the plaintiff approaching on his bicycle and that he attempted to overtake a vehicle without leaving room for the passage of approaching traffic and without sounding his horn.

It was claimed that plaintiff had sufi‘ered total and permanent incapacity as the result. The sum of £237 05 Ed was claimed a-s special damages together with £ISOO general damages. *
