AN IMPORTANT CASE TO LOCAL BODIES.

(BY TELESItAPH.— OWN COIMESPONDENT.) Auckland, Last Night. At the Sdpreme Court, in Banco, to-day, a case of considerable importance to Road Boards was heard. Robert Knox, a contractor, appealled from the decision -.f the K. M. at Gisbnrne in a suit which he brought against the Patutahi Road Board. The Board had held back £30, on the ground that the work had not been done to their satisfaction. It appeared that the contractor discharged his men upon receiving a certificate from the Board's engineer to the effect that the work was satisfactory; but that upon certain complaints being made by settlers as to the state of the road, another engineer was employed who g.ive a decision adverse to the contractor. Mr Button argued that the Board was bound to abide by the decision of its own engineer, who had passed tho work. Mr Cooper, for the respondent body, argued that the decision given by several engineers regarding the unsatisfactory nature of the work should be final, and the decisiou of the R.M. at Gisbome be upheld. His Honor said he would reserve julgment in the meantime in order to consult the authorities quoted.
