THE COURT OF APPEAL.
♦ LOVETT LOSES HIS CASE. A PROHIBITION VICTOEY. (by telegraph.—press association). Wellington, Last Night. In the Auckland Hospital Board v. Lovett case affecting the liability of Hospital Board for the maltreatment of patients, the Appeal Court allowed the appeal with costs on the middle scale. This verdict is against Lovett's right to recover damages from the Charitable Aid Board. In the Sydenham licensing case the Court allowed the appeal. This is a prohibitionist victory affirming that licensing benches have absolute discretion in refusing licenses. In the caw Carr v. Thomas, involving the title to land in Wakefield-street, Auckland, formerly conveyed to a Total Abstinence Society, the Court held that Thomas had acquired a title by occupation. .^
