RESIDENT MAGISTRATES COURT, HAMILTON.
Wednesday.—(Before Captain Jackson, R.M.) Sheep-worrying : Samuel Teas v. Thomas —Mr Dyer appeared for the plaintiff, and Mr Swarbrick for tbo defendant. This case was continued from last court day. Alfred Tea*, son of the plaintiff, gave evidence which corroborated that of his father taken on the previous court day. John Kenny and John Murny were also called for the plaintiff. For the defence, Mrs Thomas, the dofendant stated that the dog was kept on the chain during the time the sheep worrying occurred. John Churches and Zenas Owen were also examined, and the case was further adjourned until ten o'clock this morning. Stud Company v. T. H. Bar'.vell.— Claim, £3 3s for services of a stallion. Mr Dyer appeared for the plaintiffs, .and Mr Swarbrick for the defendant. This case had been called at 11 o'clock, but defendant did not put in an appearance, and judgment was given for the amount claimed and costs, £2 3s (id. The defendant appeared about half-past 11, and applied for a re-hearing, which was granted, the plaintiff offeiing no objection.—Mr C. Lake proved the service, and stated that no conditions were made. The defendant, however, stated that he had arranged with Mr Lake that if the mare did not prove in foal she should be served next season for half-price, and that a breach of agreement had occurred. —His Worship said ho would give defendant the benefit of the doubt, and gave judgment in his favour, but would irjt allow costs.
