Stout, argued that the Supremo Court Act, must bo read with the Civil List Act, 187.'!, which established salaries for tho Chief .Justice and four puisne Judges, lie also contended that there was no contract with Mr Mil wards, and if so it was simply for the Commissionership. in concluding, he thought it was for the benelit of the defendant, the Bench, and the colony that these proceedings had been taken, and the case would be, and ought to be, a warning to the Executive not to attempt to deal with the high office of Judgeship of tho Supreme Court by makm? it an addendum to a Native Commissionship, and not to appoint Judges without frankly consulting Parliament. The Court, reserved judgment. It is understood that the wiil go to the Privy Council whatevor nny be tho result.
