R. GIBBONS V. PIAKO COUNTY COUNCIL
A.T tliii Resident Magistrate's Court, on Thursday, the iidjourned case of It. 1 , . Cibbons v. the I'iako County Council was linUied. Mr W. M. J [ay addressed the Court on the evidence, and said he laid one ojection, viz., that the special damages claimed were not particulanzed, and which he contended would be fatal to theca.se, and quoted several Knglish and Xew Zealand cases in support of his objection. Mr Hay also remarked on the evidence given by some of ulaintitt's witnesses which he thought was not very satisfactory either to the Court or to Mr Uinle himself, and it \va< very defective. At dm conclusion of Mr Hay's address the Resident Magistrate said that his mind was now quite made up, •uid Mr IVale said that in that case it would be useless for him to address the Court, Mr ISeale elected to take a nonsuit, the costs aiuountiiig to £i)L's Hd.
