Ykwkrday.—(Before Capts. Steele and McPhorson, J.P's). Police v. J. Deegan.— Breach of railway bye-laws. J. Deegan, coach piMpnotor, was charged by Constable Wild with driving across the railway line on Friday 20th .September, whilst the train was approaching, and within seventy yards of his coach. Mr Fleming, stationmaster, deposed tn seeing the accused whipping up his horse.-:, apparently in order to cross the lino before the train passed. Accused said he could ant see the train approaching, or hear is owing to the strong wind then blowing. The bench considered the offence a very serious one, and said the highest penalty was £50. They would however consider the accused's plea, and fined hint 5s and costs 7 s. Sheep Ixspectok v. A Couisicti'.—For having .sheep infected with lice. Fined £1 and costs. Polick v. A. Mates.—Stealing a portion of the Hamilton West school fence. Fined 10s and costs 12s, with Is value of the rail. 14 days allowed in which payment is to bo made. Lrc Qijesne v. Manning. Claim .€lO 13s 4d, including interest. Confessed. SAME v. C. McKknzie JuNU.—Claim £10 12s Sd on 1.0. U. dated Ist July, 1884, for £0 l'Js 2d, and interest to date.-Plain-' tiff stated no part of the debt had ever be.ni paid. Defendant disputed the charges.—T. C. Hammond, accountant, deposed he had gone over MeKerizie's accounts, and produced papers showing that subsequent to the date of thel.O.U. plaintiff had rendered an account for balance, £5 9s 2d, which proved some payment had been made. The 1.0. U. bore six penny stamps and was virtually a promissory note. He pointed to several inaccuracies in the account.— Plaintiff acknowledged ail omission in not crediting the payment of an instalment of 10s,—The Court pointed out certain discrepancies in the amounts shown as owing at different times, and gave judgment for £5 'Js 2d, with £1 costs, to be paid in monthly instalments of 10s each. The question of interest was not entertained.
