Fkiday.—(Before Gapt. Jackson, U.M.) Tuasdalb v. TnoMJ'su.v. —Judgment summons. Ordered to pay £1 per month till the whole amount of tho debt £5, be paid, in default seven days. Malicious Ixjuuv to Puopkuty.—W. Colley was charged on tho information of (Jhas. Miller, with having, on the night of the 23rd January, wilfully and maliciously damaged a door in the house of tho said Charles Miller, to the amount of 10s.—Defendant pleaded not guilty.—Charles Miller deposed to tho defendant coming to his house on that night between 10 and 11 p.m., beating the door with a stick (produced) and splitting a panel. Witness went out with a dinner knife in his hand. Defendant and others then went away, but returned in about ten minutes and threw the stick at the diior, splitting it iu another place. Threatened to fire on them if they did not go away. Kecognised the defendant by his voice.—Defendant did not pay for tho damage. Opened tho door while the blows were being struck, and saw defendant on the verandah. Had no doubt whatever as to the identity of the defendant. Knew him for three or four years. Saw his face clearly, as the night was not very dark.— Annie Walker, wife of last witness deposed to recognising defendant by his voice when hn spoke to her husband.—Defendant sworn, deposed that he was not at plaintiff's house on thn night in question. Was iu 'IV Awamutu that evening, but left before K) p.m., reaching home before 11 p.m. Was overtaken on the road homo by Mr Urahiim. Witness' brother reached homo about live minutes after witness. McWilliam deposed to seeing defendant in Tβ Awamutu on the :23rd January Vetween '.) and 10 p.m. Went and had a drink, and then defendant got his horse, and he and witness walked down the road together p.ist the church and over the bridge, they talked f<.r a few minutes, and then defendant trotted off in the direction of his li'iiiie, and witness saw him m> more that night, that was between 11.30 and 10 p.m. Witness then went to bed. The witness brought by the constable pave no evidence of any importance, except that it did not prove tho presence of defendant's brother in To Awamutu on the night in question. — 11. Graham, on oath, corroborated tho evidence of defendant, Case dismissed.

When the mistake was discovered, witness made it known among the natives in order to find the owner. Accused claimed the cow as his and demanded ,t(i which witness paid. Subsequen'.ly another native named Te Uaewhaiiake said tho cow was his. and that he had bought it when a calf at L'ukekohe. at BuckUmd's sale, earmarking it after driving it to Ins place near Mercer, from which place it was driven when a cow to Hanff.jtiUi. Owing to the statement of the second claimant he instituted these proceedings. Several witnesses were examined on both sides, each swearing as to the ownership and identifying the skin (produced). Tho case occupied two days, and the court finding the evidence so conflicting dismissed the case without costs.
