[Ul r TELEGRAPH. — J'RESS ASSOCIATION.] Wellington, Wednesday. _ In bauco court, this afternoon, an application for a new trial in the case Stapleton v. J. Sniith of Te Aro House, hoard recently, in which the jury gave a verdict for £500, was refused. Judge Richmond, in delivering judgment, said that the award was somewhat excessive to him. and if he had beon on the jury he would probably not have given so much. That, however, was not the question. The Court had to determine whether the; verdict of the jury ought to be interfered with, and the Court was of opiuiou that the jury were justilied in giving what were tunned vindictive damages, and under those circumstances he saw no reason for interfering with the award. The Chief Justice concurred in this opinion.
