Judgment for plaintiff, with costs 12s. House-stealing.—Wiremu Te Whitu was charged with having stolen a mare and foal, the property of Sarah Heslip.— Mr Hay defended, and contended that the horse had not been taken with a felonious intent, as accused firmly believed h to be his property. It was one of a number of horses that were seized by the sheriff in lStf-l at Pukekura, and were afterwards sold by Messrs Hunter and Co. The accused was not a defendant in the case, and yet his horses were sold, and he (Mi- Hay) thought accused was quito risrht in taking what was bis property; and indeed ho had instructed him t.ido so. Ho then referred the R.M. to a similar case that he had previously tried, and in which he gave a verdict for the defendant.—Very voluminous evidouce was taken, after which the prisoner was discharged. Mi- Kny applied for tho horses to ba given to Te Whitu, but the Court declined to interfere. The Maori subsequently obtained possession, and took them home with him. Another Horse Case.—Mere Parata sued Tiabuia for the recovery of a horse, which she stated ho had given her five years ago, and had now taken it from her. —Mr Dyer appeared for plaintiff, and Mr Hay for defendant, Mr Quick acting an interpreter'—The c.ise occupied the wliolo afternoon, the evidence being very voluminous,, but of little interest to the public. Tbq Court adjourned at 5 p.m. until Tuesday at 10 a.m.
