HAMILTON BOROUGH COUNCIL Till-: adjourned meeting of the Borough Council was held last night. Present,: 'I he Mayor, Crs. Knox, Jones, Von Sturmer. Bell, Wood and Missen. VlN'CKN'r's The. Inspector of Nuisances made the following report: — His Woitsuir thk Mayor and Cocncii. I.oits : tientlemen, —In accordance with your instruction I have, inspected the drain running through Mr T. Vincent's property, 27-1, Hamilton West, and find that it is the cause of a nnisancc by the water stagnating and the weeds smelling. Also that through being so near the house (20 feeet), it is dangerous. I have (fee., J. M. (tKLl.i.vc, Inspector of Nuisances. Cr. Jones moved and Cr. Von. Stunner seconded that the Council go into committee to consider the matter.—Cr. Knox moved an amendment that the Council does not go into committee which he said was absurd, as the whole question had already been threshed out. There was no seconder and the motion was carried. The Council went into committee. The previous minutes on the matter were read. Cr. Von Stunner moved that Mr Vincent's letter be received. Cr. Wood seconded. —Cr. Knox said this meant, shelving the question, which was very improper in the face of the report of the Inspector of Nuisances. The Council would | find itself involved in a lawsuit. Cr Jones said the Council should obtain the opinion of an Auckland solicitor, and if the Council was found to bo legally bound to undertake this expenditure of the people's money, it would be a ditfeient matter, Cr Von Sturme.r said they need not go hp.vond Mr McGregor Hay's opinion. Cr Knox said Mr Hay was never asked his opinion with reference to the question of nuisance. He advised the withdrawal of the motion. The Council must face the matter boldly, and meet it through the report of the Inspector. He moved that the report of the Inspector be sent to Mr Hay for his opinion as to the liability of the Council, and that the Mayor. Cr. Von Stunner and the mover see Mr Hay on the subject.—Cr. Von Stunner agreed that they had a hard matter to face, but lie maintained that the legal opinion was wanted, and that the Council was only responsible for the watercourse, and not the drain. Ho asked leave to withdraw his motion.—Leave granted.—He moved, as an amendment to Cr Knox's motion, that the best legal Auckland opinion as to the Council's liability both as regards the watercourse and drain be obtained.—Seconded by Cr. Jones.—Cr. Knox again said the Council wore hound to abate the nuisance.—The Mayor said they must go into the matter carefully. It might merge into a system of black-mailing.— Cr. Wood thought there must be a mistake in the estimate given of the cost of the work.—Cr. Knox thought they could not get any opinion better than Mr Hay's, which was quite clear on the point.—Cr. Von Stunner, with the consent, of his seconder, withdrew the amendment in favour of (Jr. JCnox's motion.—Cr. Jones said the opinion should be taken in writing, and afterwards submitted to the whole Council.—Motion put and carried unanimously.—Progress reported and the Council resumed. —Cr. Knox moved and Cr. Jones seconded, that the report of the committee be adopted.—Carried. Wouics Gommittkk.—Cr. Knox moved that the Mayor be Chairman of the. Works Committee lor the ensuing year.—Cr Von Stunner seconded and bore testimony to the valuable services hitherto rendered by the Mayor,--IJis Worship said he had very little time at his disposal and would like someone else to be appointed.—Motion
carried. Valuation List.—The valuation list for tho year showed a decrease in the animal value of £11)80 llis over last year's valuation. —Cr. Knox thought the valuation was excessive in tho face of property being deproceated and could not find occupier-:.—Cr. Jones did not think it was tlie place of the Council to find fault.--The Mayor said as the valuation was Hficjor the Council's estimate they should not complain. There would, no doubt be yo'.iia appeals.--Cr. .Jones moved and the Mayor seconded that tho valuation be received and adopted in accordance with the law.—Carried. Clerk ox-' Licensing Bench.—The report of the Leg.il Committee on the salary paid to this official was adopted, Aiuiii.uw ok Rath.—The Legal Committee reported that steps be taken to recover the rates due by Mr C. N. Brassey.— Adopted. The Baths. —The Baths Committee reported on this matter and recconimeud that the improvement and offices be effected. The Mayor said that in a personal inspection of the state of tho baths, he saw it was really necessary to erect closets, efc. Cr. Kum;: moved tl)at the as recommended be carried out not Co exceed fill. Cr. Bell socouded and the motion was carried. Market Resekve,—Cr. Knox moved that the market reserve be cleared of furze and be fenced in. Cr. Sandes seconded, but did not see that it was advisable to fence the reserve until it was decided what to do with it. The Mayor agreed with Cr. Sandes, and thought the furze should, however, be eleared off. Thackkuv - stkeet.—Tho foreman of works reported that Contractor Kelly had no claim against the Council Eor re-build-ing a culvert.—Report adopted. Ifoi'iCE Of Motion.—Cr. Knox gave notice tl)!>t he would ipove that this Council propeed lyjth the erection of abattoirs as originally intended. . This was all the business, Domain Board.
The Council then resolved itself into the Domain Board. The minutes of the last meeting were read and confirmed. Sydnky Squaiiis.—The application of Mr D. Lees to lease Sydney Square on certain conditions, in which he undertook to erect a wire fence, plant trees, &c. and graze sheep, was taken into consideration —Mr Knox opposed sheep-grazing 011 the square. 1-fe thought it more proper to call for tenders for leading the ground. They should bo vary jealous about leasing the square. —Mr Wood said they should make, a condition that the ground be rolled after each successive crop of hay, and that sheep would improve the ground.—Mr Knox moved and Mr Missen seconded that tho letter be received.—The Mayor said he was in favour of sheep 011 the ground. He did not think they could lease it for four years, but 110 thought that it would be well to consider the olfer which was in good faith. In a short time, unless some care was taken, the otrasss would die out, and tho trees needed looking after, lie proposed as a 11 amendment that the square be let on such like terms from year to year, by public tender, and that the Recreation Committee draw ijp the. conditions.—Seconded by Mr .[ones. He tljought- it could be let Oil such teniis, and tha land bp benefited by it, Mr Von Stunner supported the amendment, provided the trees were, looked after. The grass was now very rank, in fact not grass. Mr Sandos agreed with those speakers. It would be very beneficial to have sheep op the gfound. They should advertise for tenders. iVIr ]£nox thought there would be general objection to handing the square to anyoije iu this manner, Mr .tjell ] thought it would be a good thing to have uliuap gracing on the ground. The amendment was put and carried. SwnfMi.vi; Match us ox thk Laicij.— Tho Swimming Races Committee wrote asking the JJoard to build a small jetty oil tho lake for the convenience of tho races. I t could bo of a permanent character and would be of use to bathers &c.—Mr. Knox moved that the request bo granted and that CIO be expended. We have one of the finest lakes in tho Island and we should do everything to make it attractive. —Mr Yon Stunner seconded and quite agreed with tho mover in liis remarks. Very few people know what a lovely sheet of water wo injys Ji.ere,—Mr .Jones said, looking at the stats of fclie overdraft, lje fchqught the Board would not be warranted in jnpurring the expense.—ln reply to Messrs .lanes and Sandos, the Clerk said that the income 1 was £150, and there was £!)0 for interest 1 011 the loan of .£IOOO.
