. Friday.—(Before Mr Northcroft, R.M.) H. Asher v. Hote Thompson.—Judgment summons, claim, £10. M r Dyer for plaintiff. Mr H. Cowper, who was clerk of the Native Lands Court which aat recently at Cambridge, was put in the witness box to give evidence to^jrove tbat the defendant wm interested in certain lands awarded by the court on that occasion. The court ruled that this could not be accepted as evidence, being from the records of another court, and Mr Cowper said he could not swear to the fact from his own knowledge. Mr Dyer then asked for a further adjournment. Granted. Waikato Coal and Shipping Company v. J. R. Land.—Claim, £27 lid or a judgement summons. Mr Hartley, on behalf of Mr Whitaker, applied for an adjournment for two months. Granted. t D. Stewart v. Arbkatera.—Claim, £11 15s Gd on judgment summons. Mr W. Kincuid was put in as a witness to prove that the defendant was in possession of means and had cashed a cheque at his store tor £10. The defendant, on oath, stated he was unable to pay, as Mr Gwynnetb, who is trustee in his estate, had the management of his affairs. He took the j judgment summons to Mr Gwynneth, and h» came to the court to-day to say he was not in a position to pay the debt. The cheque cashed at Kincaid*s belonged to his children. He went to Auckland as a witness far Mrs Robertson, of Rotorua. The case was adjourned till 2 o'clock m order that Mr Gwynneth might be nubpoened on the case. , C. Botof. v. W. Lyox.—Claim £1" 0s lid, for goods supplied. ' Judgmeut for plaintiff, costs 12s. • '» l W. Kincaio v. D. McKinnon.—Claim £3, balance of account. Confessed except the interest, which defondant declared he had never been oaked for by any other storekeeper for the twenty years he had been here. Judgment for plainttft;, with costs, 11s. , .. . I. Piako County Council v. D. Anderson.—Claim, £4 15s Bd, Amount, less Gd, bad been paid into court. Mr Dyer, for plaintiff, accepted this as satisfaction. - After the adjournment, th» cate Stewart % Arekatera was rfcumed. John Gwynneth was called, and stated tbat he was trustee in the estate,' and that there were moneys due from the Waikato Timber Company ior timber at Waotu, which belonged to the estate; that the defendant Was not yet re' laased from bankruptcy, and that an application had been put m to detain money for payment of Areketera s debts. He did not know whether defendant was in receipt of other moneys. There were other moneys over which he had no control, but he understood they were taken out in stores for family use. The horses had been lost in the bush. The bankruptcy was under the Act of 1876. The Court was of opinion that it was a hard case that the plaintiff should be debarred from recovering a jmt debt for boarding and maintaining defendant's son whilst at school. There should be an allowance out of the estate to enable defendant to live and support his family. He would make an order, and perhaps the money would then be forthcoming. He ordered that the claim be paid, with corti £2 13s, before the 28th M«y, or in default two months' imprisonment. „
