At the Magistrate*! Court this afternoon, D. Dark brought an action against the Island Bay Racing Club for £2 6s, being the amount which he alleges should have been paid to him as a dividend on the horse Talebearer in the Consolation Race. The race first resulted in a dead htat between Talebearer and Little Scrub, but in the runoff Little Scrub won. The stewards authorised the totalisator to pay out on that horse. Plaintiff contends that the money in the machines should have been divided. After a long argument his Worship held that the investments in totalisators were nothing more than bets on racing, and therefore could not be recovered. Judgment for defendants with £9 costs. Notice of appeal was given. At the R.M. Court this afternoon, a young man named Frank McDowell was committed for trial on a charge of embezzling tho sum of £94, moneys alleged to belong to James McDowell, clothier. The Government eteauier Hinemoa sails to-day or to-morrow for Kawhia harbour with a load of telegraph poles, putting Kawhiu in telegraphic communication with other part* of the colony. I believe the present arrangement is that the Hinemoa shall afterwaids sail via the North Cape for Waiwera to pick up Sir J Vogel and bring hiic to Wellington.
