THE PIAKO COUNTY COUNCIL AND THE THAMES CHARITABLE AID BOARD.

Messrs Hesketh and Richmond have given their opinion as follows on the claim of the Thames Charitable Aid Board against the Piako County: -"We have your letter of the 30th December, 18So, enclosing notice of 3rd December, 1885, by which notice the chairman of the Pialco County Council is requested to pay to the " Thames District Charitable Aid Board " the sum of £230 2s sd, and aWo the sum of £285 Is 7d to the " Thames District Hospital Board." This notice does not appear to have been carefully framed. The Act of last session has not constituted boards under the names referred to in the notice, and we are disposed to think that there is no call upon you to recognise the notice given in such an informal way. It may be said, however, that the act does not expressly provide for notice being given to local authorities, and it may be a question whether notice is essential. In the absence of specific steps we cannot say confidently whether the proper boards have m a lawful manner ascertained the amount of their requhement up to March, 188(i, and whether they have lawfully allocated the proportions payable by the several local authorities. Under these circumstances we cannot advise you to pay, and on the facts before us we have the greatest doubts a% to whether these contributions could be enforced."— HESKErH AND RICHMOND.
