MR BADGER'S STATUTES IN COURT.
At the R M. Court, Hamilton, on Thun day, Messis W. A. Giaham and John Knnx, J.P., sat as a commission to hear the evidence for the defend mt in tho action Wilfred Bidgerv. Heniy William Noithcioft, in which the founer sues tho latter for £2 7s, the puce of the repnnt of Now Zealand Statutes alleged to have boon dehveiod to defendant. The folloAing cvi deuce was taken :— Lewis O'Neill, solicitor, Hamilton, do posed :— I oulered Mi Badgei's book and expected to get a repnnt of the statutes. The book (Vol. I) pioduccd I do not c insider a teprint of such statutes, as it i* accompanied by a list of alteiations. Thu paper is mfeiioi and so is the punt, which is very tr\mg to tho eyesight. It has no maigmal notes and no analysis, and is infenoi in every respect to the Government statutes. Mr Bvdgci uudoitouk m his cncnlar to supply a "icprint" of the statutes. I do not consider ho has kept faith. I cannot say whether the i splint is reliable. I have ceased to use it because it hints my eyes. Six long slips of enata must be incorporated with the work before it piofe.sses to be correct. It took mo. two or three evenings to m ike these alterations befoie I could use these statute*. George Edgecumbe, manager of The Waikato Times, deposed : I do not consider the .statutes of Mr Badger (piod.iced) are a reprint of the Gov eminent statutes from a printer's point of v lew. The marginal notes if inserted would have necessitated a larger volume and increased the, expense of composition. I should not, consider that I had cirried out a contract to reprint the Government statutes if I had pioduced a book like this (Mr Badger's). Henry Lewis Hoopor, pi niter, gave similai evidence. H. W. Northcroft, R.M., defendant in tho action, deposed that ho received a circular from Mr Badger (produced), and on the faith of this hs ordered a copy of the statutes, which copy ho hid never received nor had he received information from Mr Badger that it was went to him. What statute* of Mr Badger's he had seen he did not consider reprints of the Government statutes, and was of opinion that plaintiti had failed to cairy out the contract made in the circular, and that the books weio useless. F. J. Yon Sturnipr give evidence corroborative of that adduced by Messis Edgecumbo and Hooper. This concluded the piocccding-?, and the justices coi tilled to the depositions, which will bo forwarded to Chnstchurch, wheie tho case will be determined.
